Real Estate Law

Real estate is truly a business of “location, location, location.”  Land’s most unique and irreplaceable characteristic is its location.  No other property will have the same characteristics and traits.  Texas law recognizes that land is unique and irreplaceable.  Investment in real property is one of the most significant and largest investments many businesses and individuals will make.  This investment involves voluminous research and negotiation.  Businesses plan meticulously where to locate their corporate headquarters, their distribution centers, their retail locations.  After all this, there is still no certainty that the desired lease space or property will be secured.  Negotiations can fall apart over price, title, lease terms, due diligence issues, or a myriad of other reasons.  An experienced attorney knows how to overcome hurdles and obstacles in negotiations.   

However, negotiation is only one step in the process to securing your ideal lease or property.  Inspections, surveys, title searches, and other action are necessary to ensure that you are getting what you are buying.  Finding out there is an easement, or that the property line is 10 feet off, or that a property is restricted in its use after the purchase can be devastating.  Investing in an attorney to ensure you are receiving what you are buying is money well spent.  You are investing hundreds of thousands, if not millions, of dollars not just in the lease or property, but in the future of your business.   

So why do you need an attorney when there is a good real estate agent involved?  Real estate agents, while certainly being beneficial and necessary to most real estate transactions, are not able to make substantive changes to documents, as this constitutes the unauthorized practice of law.  They also frequently represent either the other party or both parties to the transaction, so under these circumstances there is no one that has your interest at heart.  Lastly, they are commission driven, so it is worthwhile to have an experienced attorney looking over your shoulder to ensure a transaction is in your best interest.  Our attorneys work with other attorneys and real estate agents to assist you in securing the lease or property you need to make your business flourish.
